1. The agreement

These terms are between you and Sombrero Holding AS, a company registered in Norway (organisation number 935 338 646, registered address Holmenveien 51E, 0376 Oslo, Norway), which operates Partando. By using Partando you agree to them. If you do not, please do not use it.

Our Privacy Policy explains what we do with your personal data and forms part of this agreement.

2. What Partando is

Partando is a shared music queue for parties. A host connects their own Spotify account and picks a speaker; guests join with a code and add songs, hype the ones they like, and react. The queue orders itself by what the room wants.

Partando is not a music service. We do not host, stream, store or deliver any audio. All music plays through the host's own Spotify account, on the host's own device.

Partando is free to use. There is nothing to buy in the app.

3. Accounts

You can join a party as a guest with no account at all. If you create or claim one, keep your sign-in details to yourself — you are responsible for what happens under your account. Tell us promptly if you think someone else has access to it.

You must be at least 13 to use Partando. Hosting requires Spotify Premium, which carries Spotify's own age and eligibility rules.

You can ask us to delete your account at any time by emailing privacy@partando.com.

4. Spotify is required

Hosting a party requires an active Spotify Premium subscription. Your use of Spotify is governed by your agreement with Spotify, not by us, and you must comply with it while using Partando.

Partando depends on Spotify's platform. Spotify may change, restrict or withdraw that access at any time, and if that happens Partando may stop working in whole or in part, possibly without notice. That is outside our control.

Partando is intended for personal, non-commercial use — parties among friends. Do not use it to provide music in a business or public venue such as a bar, restaurant, shop or club. Playing music in those settings needs licences that neither a personal Spotify account nor Partando provides.

5. How you may use it

Hosts are responsible for their own party: you control who has your room code, and you can turn photos off, require photo approval, remove content and end the room.

6. Your content

Photos you take, names you choose and notes you attach to tracks remain yours. You give us a limited, non-exclusive, royalty-free licence to store, display and transmit that content strictly to operate the service — to show your photo on the party's TV view, to display your name in the room, to build the recap. That licence ends when the content is deleted, other than for backups already made.

You are responsible for what you upload, and you confirm you have the right to upload it. We may remove content that breaches these terms.

We respect copyright. If you believe something on Partando infringes your rights, email privacy@partando.com with enough detail to identify the work, where it appears, your contact details, and a statement that you are the rights holder or authorised to act for them.

We will review and, where appropriate, remove the content. We may also disable accounts that infringe repeatedly.

Music metadata, cover art and track information come from Spotify and remain the property of Spotify and its licensors.

8. No warranty

Partando is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any defect will be corrected.

This disclaimer is given on behalf of Spotify as well as ourselves. Spotify makes no warranties of any kind in respect of Partando, gives no representations about the Spotify content or service accessed through it, and is not responsible for Partando or for any loss you suffer through using it.

Nothing here limits rights you have as a consumer under Norwegian or EU law that cannot lawfully be excluded.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost data, lost profits or lost opportunity, arising from your use of Partando. Because Partando is free, our total liability to you for any claim is limited to NOK 1,000.

Spotify is a third-party beneficiary of these terms and is entitled to enforce them directly against you. Spotify is not a party to any dispute between you and us, and has no liability to you in connection with Partando.

Again, this does not affect consumer rights that cannot lawfully be excluded.

10. Ending it

You can stop using Partando whenever you like, disconnect Spotify from your Spotify account settings, and ask us to delete your account.

We may suspend or end your access if you breach these terms, or if we need to protect the service or other people. We may also discontinue Partando entirely — it is a small, free product and we make no promise that it will run forever. Where we reasonably can, we will give notice.

11. Governing law

These terms are governed by Norwegian law. Disputes go to the Norwegian courts. If you are a consumer resident elsewhere in the EU/EEA, you keep the protection of the mandatory laws of your own country and may bring proceedings there.

12. Changes

We may update these terms. The date at the top shows when they last changed, and for anything significant we will give notice in the app or by email before it takes effect. Continuing to use Partando after a change means you accept the new terms.
